In response to Robert Gottliebsen’s recent article in The Australian, ‘Union Power is just one way the new laws will hit family businesses’, Catherine Sayer, FBA CEO, wrote a Letter to the Editor advocating that implications for family businesses have been overlooked to date and invites a conversation with the Federal Government to work towards a better outcome for all.

Unintended Consequences of Industrial Relations Legislation on Family Business

Family businesses are fundamental to Australia’s economy and our social fabric. These businesses, ranging from small local shops to large multinational corporations, account for 70% of all Australian businesses and employ half the workforce. Family Business Association (FBA) represents this vital sector across Australia and New Zealand and continue to be concerned about the unintended consequences of the Industrial Relations Legislation changes on family businesses.

Family businesses are integral to Australia, providing stability, trust and support to their local communities and across our whole country. It is essential that their unique needs and contributions are recognised and safeguarded in any new legislation.

The imminent Industrial Relations Legislation changes on 26 August 2024, as highlighted by Robert Gottliebsen, pose significant challenges to Australian family businesses. While, of course, we agree in treating all employees fairly and reasonably, the new legislation may impact the trusted relationships with employees that characterise family businesses. The changes will also impact the way family businesses are run, adding additional cost burdens and risking the delicate balance that allows these businesses to innovate and thrive. Any long-term impact on family businesses, will be detrimental to their employees and all of Australia.

FBA is deeply concerned about the changes the new legislation will bring. We ask for the voices of family businesses to be heard and considered in policy-making processes to avoid inadvertently impacting on this vital sector.

FBA and our members welcome the opportunity to work with the Federal Government towards great outcomes for all. By working together, we can ensure that family businesses continue to contribute significantly to our economy and community.
